Kargoe Privacy Policy: Your Privacy Rights

Kargoe is here to level the playing field, empower the small guys and create a community where everyone feels safe and secure.  We take your privacy seriously and aren’t here to sell or share information that personally identifies you.  Be free to explore, sell, shop and make new connections in an environment where you can be you.

Kargoe knows that your privacy is important to you, and we want you to know that it is important to us too. We created this Privacy Policy to explain the types of information we collect through our website at Kargoe.com, our Kargoe mobile application (“Mobile App”), and the various social networking platforms that we use (collectively, “Kargoe”), how we will use, disclose and protect this information once it is collected, and how you can opt-out of some of our uses and disclosures of your information.  


By using Kargoe, you provide the consents and approvals set forth in this Privacy Policy.


Here are a few general principles to keep in mind as you read through this Privacy Policy:







What information is collected through Kargoe?


User-Provided Information

“Personal Information” is information that can be used to identify you as an individual or allow someone to contact you, as well as other information attributed with such information.  We collect Personal Information such as your name; company name; username, password; mailing addresses; email addresses; telephone numbers; social media handles and usernames; photographs; videos; gender; purchase, Kargoe use and transaction history; and interests, hobbies and demographic information.  For example, we collect Personal Information when you create an account on Kargoe; post content to Kargoe; conduct a transaction through Kargoe; sign up to receive emails or other messages from us; make purchases; enter sweepstakes and contests; complete surveys; contribute to a social forum on Kargoe; or submit a comment or question to us using a “contact us” or similar feature through Kargoe.


A “tell-a-friend” tool provided on Kargoe and/or in our e-mails allows you to send information about Kargoe or its offerings to another person.  Also, through Kargoe, you can send gifts to other Kargoe users by selecting them from the search database.  Gift recipient’s name and address will be shared with merchants, but not the purchaser.  When you use these offerings, the information will be protected pursuant to this Privacy Policy.


Your Contact Lists

If you use our Mobile App, we may request your permission to access and store the contact list maintained on your mobile phone, tablet, or other device (“Mobile Device”).  Your contact list is considered your Personal Information.  We may use your contact list information to facilitate certain Kargoe features such as to enable you to easily send communications to your contacts or other Kargoe users.  We will not use your contact list information for other purposes without first notifying you of the proposed use.  If you do not allow us to access your contact list information, certain features of our Mobile App may not be available to you.  You may at any time opt out from further allowing us to have access to your Mobile Device’s contact list via the Mobile App’s privacy settings on your Mobile Device.


Access to Mobile Device Camera, Microphone, Videos and Photos

If you use our Mobile App, we may request your permission to access the camera, microphone, videos and photos on your Mobile Device.  If you approve and/or enable it in your Mobile Device settings, our Mobile App may access and use these to allow you to make and share audio and video content with others.  You may at any time opt out from further allowing us to have this access via the Mobile App’s privacy settings on your Mobile Device.


Your Precise Location Information

When you use Kargoe, we may receive your precise geographic location from your Mobile Device, and we may use this information as described below.


Our Mobile App collects precise information about the geographic location of your Mobile Device.  If your Mobile Device is equipped with GPS or can connect with wireless access points or hot spots, or if your Mobile Device is also a phone that communicates with cell towers or satellites, then your Mobile Device is able to use these features to determine its precise geographic location.  If you have consented, the geographic location of your Mobile Device will be transmitted to us in real time any time that the Mobile App is running.  Once you set your Mobile Device to transmit its location information to us, your Mobile Device will continue to transmit its location information to us (when it is open) until you set your Mobile Device to no longer do so. In addition, photos and videos you post on Kargoe may have embedded in them the precise geolocation where they were taken.  Your precise geographic location is considered your Personal Information unless it is aggregate data and not identifiable to you.


You may at any time opt out from further allowing us to have access to your Mobile Device’s precise location information via the Mobile App’s location settings on your Mobile Device.  You also may set the Mobile App to share your precise location with other users of the Mobile App, and you can disable this sharing at any time.

When you take photos or videos that you intend to post on Kargoe, you can set your device not to embed geographic location data in the image or video file.


We may use your precise geographic location to provide the Services to you, and to localize content, information, and to monitor and improve the quality of our Services in your area.


Kargoe Usage Information

As is the case with many online services and web browsing, our servers automatically collect your IP address when you access Kargoe, and your general (not precise) geographic location.  We may also capture certain “clickstream data” pertaining to your Kargoe usage.  Clickstream data includes, for example, information about your computer or device (such as equipment type and model) or unique identification number of your installation of Kargoe; your Web browser and operating system and their settings and language, the identity of your wireless carrier, nearby Wi-fi routers and cell towers, the referring page that linked you to Kargoe, the pages, items you download, the next online property you visit when you leave Kargoe, and any search terms you have entered on Kargoe or a referral site.


Among other things, this information enables us to receive analytics reports from analytics service providers about the aggregated usage of Kargoe.  To opt-out of your usage information being included in our Google analytics reports, you may follow these instructions.


In addition, we may deploy various tracking technologies on Kargoe to collect additional information about your Kargoe use.  For example:


·       Tokens are small data files stored on your computer or device at your request and enable you to stay logged in to Kargoe.  A tokens assigns a unique numerical identifier to your Web browser or device, and may enable us to recognize you as the same user who was at Kargoe in the past, and relate your use of Kargoe to other information about you, such as your Kargoe usage information and Personal Information.  Tokens may also be used to enhance your experience on Kargoe (for example, by storing your username so you can log in easily, keeping you logged into Kargoe after you have provided your password, and storing the contents of your shopping cart as you browse) or to collect general usage and aggregated statistical information and detect and prevent fraud.  Most Web browsers can be set to detect tokens and give you an opportunity to reject them, but refusing tokens may, in some cases, inhibit or preclude your use of Kargoe or its features.  To learn more about the use of tokens, including how to manage or delete them, click here.

·       HTML5 (the language some Web sites are coded in) may be used to store information on your computer or device about your Kargoe usage activities.  This information can be retrieved by us to determine how Kargoe is being used by our users, how it can be improved, and to customize it for our users.


By using Kargoe, you consent to our collection of usage information and use of these tracking technologies as described above.


How is your information used?

We or our service providers may use the information we collect from and about you to perform the following business functions:


·       enabling users to use Kargoe and its features

·       processing and fulfilling your transactions

·       administering Kargoe and your account with us

·       responding to your requests, questions, and concerns

·       send marketing and other communications, including info about products, services, and events

·      protecting our rights and property

·       recovering debt and preventing fraud

·       customizing Kargoe to your interests and history with us

·       developing new features and offerings on Kargoe

·       for our own internal analysis, analytics, research and development

·       to assess the level of interest in, and use of, Kargoe, our e-mails and our other messaging campaigns both on an individual basis and in the aggregate

·       other purposes disclosed when information is provided to us

To perform the above functions, we may match information collected from you through different means or at different times, including both Personal Information and Kargoe usage information, and use such information along with information obtained from other sources (including third parties) such as demographic information and updated contact information.    


Aggregate De-Identified Information

We aggregate our user information together in a way that does not reveal our users’ names, contact information or personal identities.  Once we do this, we may use and disclose such aggregate and de-identified information in any way and for any purpose allowed under applicable law without your consent.


Your Opt In and Opt Out Rights

You may have the right to opt in to or opt out of certain of our uses and disclosures of your Personal Information.  For example, when you are asked to provide Personal Information through Kargoe, you may have the opportunity to elect to, or not to, receive messages from us or other users by e-mail. You may tell us that you do not want to receive our promotional messages, by sending us your name, address, email and phone number to:  support@kargoe.com.   You can also opt-out of our promotional emails by clicking on the opt-out link within the e-mail you receive.  Please understand that it may take us a few days to process any opt out request and that even if you opt out of receiving promotional correspondence from us, we may still contact you in connection with your relationship, activities, transactions and communications with us.  


Social Networking

We maintain presence on several social networking and blogging platforms, such as Facebook and Twitter, and we also incorporate some third party social networking features into Kargoe.  Through these platforms and features, we receive some Personal Information and some usage information about you, and this Privacy Policy applies to that information as well.  In addition, third party social networking platforms have their own privacy policies which explain how the third parties that provide them will use and protect your information.  In accordance with those policies (and your privacy settings within your social networking accounts) information about your activities on Kargoe (such as “Mary Jane purchased this lipstick.”) may be published to your social network.


Do we share Personal Information and Kargoe Usage Information with others?


Yes.  We may share the information we collect on Kargoe with others for a variety of reasons.  In addition to the kinds of information sharing you might expect, such as sharing with third parties who need your information in order to provide services to us and to you, and sharing what you voluntarily post to public areas on Kargoe, we may share your information:


·       with our co-sponsor(s) if we obtain your information in connection with a contest, sweepstakes, offering, or other promotional activity that is jointly offered by us and any third parties, unless you instruct us not to by following the instructions in the Opt In and Opt Out section above

·       when we believe in good faith that disclosure is necessary to protect our rights or property, protect your safety or the safety of others, investigate fraud or respond to a government, judicial or other legal request, or to comply with the law

·      with credit bureaus, such as late payments, missed payments, or other defaults on your account

·       in connection with a corporate change or dissolution, including, for example, a merger, acquisition, reorganization, consolidation, bankruptcy, liquidation, sale of assets or wind down of business.


Do Not Track Disclosures

Some web browsers may transmit “do-not-track” (DNT) signals to the websites with which the user communicates.  Because of differences in how web browsers incorporate and activate this feature, it is not always clear whether users intend for these signals to be transmitted, or whether they even are aware of them.  We currently do not change our tracking practices (which are explained in more detail in the “Kargoe Usage Information” section above) in response to DNT settings in your web browser.

Our third party partners, such as [web analytics companies, collect information about your online activities over time and across Kargoe and other online properties. These third parties may not change their tracking practices in response to DNT settings in your web browser, and we do not obligate these parties to honor DNT settings.


Call Recording

When you speak with our customer service representatives on the phone, your calls may be recorded and/or monitored for quality assurance and training purposes.  By speaking with our representatives, you consent to this.

Your Access Rights

You may review, update or modify certain of the Personal Information that is stored in your user account on Kargoe (if you have one) [by logging in to the “My Account” or similar area of the Site] or by contacting us using the “Contact Us” information below.  We may ask you to verify your identity and to provide other details before we are able to provide you with any information, correct any inaccuracies, or delete any information.  Your right to delete your information is subject to our records retention policies.


Your California Privacy Rights

California's "Shine the Light" law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses' practices related to disclosing personal information to third parties for the third parties' direct marketing purposes.  Alternately, such businesses may have in place a policy not to disclose personal information of customers to third parties for the third parties' direct marketing purposes if the customer has exercised an option to opt-out of such information-sharing.



While we endeavor to protect the security and integrity of sensitive Personal Information collected via Kargoe, due to the inherent nature of the Internet as an open global communications vehicle, we cannot guarantee that any information, during transmission through the Internet or while stored on our system or otherwise in our care, will be absolutely safe from intrusion by others, such as hackers.


If you correspond with us by email, using Web forms like a “contact us” feature on our Site, or otherwise electronically, you should be aware that your transmission might not be secure.  A third party could view the information you send in transit by such means.  We will have no liability for disclosure of your information due to errors or unauthorized acts of third parties during or after transmission.


If you create an account on Kargoe, you are responsible for maintaining the strict confidentiality of your account password, and you shall be responsible for any activity that occurs using your account credentials, whether or not you authorized such activity.  Please notify us of any unauthorized use of your password or account or any other breach of security.


If we believe that the security of your Personal Information in our care may have been compromised, we may seek to notify you of that development.  If a notification is appropriate, we will endeavor to notify you as promptly as possible under the circumstances.  If we have your e-mail address, we may notify you by e-mail.  You consent to our use of email as a means of such notification.  If you prefer for us to use the U.S. Postal Service to notify you in this situation, please email us at support@kargoe.com and let us know.


Third Party and “Linked-To” Online Properties

The Apple and Google app stores have their own privacy policies that disclose how Apple and Google will collect, use and share your information.  Kargoe has no involvement or control over Apple’s or Google’s privacy practices.


Kargoe may contain links that lead to other online properties.  We are not responsible for these other properties, and so their posted privacy policies (not this Privacy Policy) will govern the collection and use of your information on them.  We encourage you to read the privacy statements of each online property visited after leaving Kargoe to learn about how your information is treated by others.


Changes to this Privacy Policy

We may change this Privacy Policy from time to time.  When we do, we will let you know by posting the changed Privacy Policy on this page with a new “Effective Date.”  In some cases (for example, if we significantly expand our use or sharing of your Personal Information),  we may also tell you about changes by additional means, such as by sending an email to the email address we have on file for you.   In some cases, we may request your consent to the changes.
